Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off Period: the period within which the Consumer may exercise the right of withdrawal.

  • Consumer: a natural person who is not acting in the exercise of a trade, business, craft or profession and enters into a distance contract with the Trader.

  • Day: calendar day.

  • Continuous Transaction: a distance contract relating to a series of products and/or services, where the obligation of delivery and/or purchase is spread over time.

  • Durable Medium: any means that enables the Consumer or the Trader to store information directed personally to them in a way that makes future reference and unchanged reproduction of the stored information possible.

  • Right of Withdrawal: the Consumer’s right to withdraw from the distance contract within the Cooling-off Period.

  • Trader: Boutique Eliza, trading name of J&T Enterprises, who offers products and/or services to Consumers at a distance.

  • Distance Contract: a contract concluded between the Trader and the Consumer within the framework of a system organised for the distance sale of products and/or services, whereby exclusive use is made of one or more means of distance communication.

  • Means of Distance Communication: a method that can be used for concluding a contract without the Consumer and the Trader being together in the same place at the same time.

  • Terms and Conditions: these current Terms and Conditions of the Trader.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by Boutique Eliza and to every Distance Contract concluded between Boutique Eliza and the Consumer.

Before the Distance Contract is concluded, the text of these Terms and Conditions shall be made available to the Consumer. If this is not reasonably possible, it will be stated before the Distance Contract is concluded that the Terms and Conditions are available from Boutique Eliza upon request and shall be provided free of charge as soon as possible.

If the Distance Contract is concluded electronically, the text of these Terms and Conditions can be made available electronically to the Consumer in such a way that it can be easily stored by the Consumer on a durable medium.


Article 4 – The Offer

If an offer has a limited period of validity or is subject to conditions, this shall be explicitly stated.

The offer is non-binding. Boutique Eliza is entitled to change and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered.

Images of products are a true representation, but colours may vary slightly from reality.

Each offer contains sufficient information for the Consumer to understand their rights and obligations upon acceptance of the offer.

Important regarding international shipping and customs duties:
Prices shown do not include import VAT, duties or clearance charges that may be imposed by UK authorities or couriers. These costs are the responsibility of the Consumer and are usually collected by the courier before delivery.


Article 5 – The Contract

The contract is concluded at the moment the Consumer accepts the offer and meets the stated conditions.

When the Consumer accepts the offer electronically, Boutique Eliza shall promptly confirm receipt of acceptance electronically.

Boutique Eliza shall take appropriate technical and organisational measures to secure electronic data transfer.

Boutique Eliza may investigate whether the Consumer can meet payment obligations. If there are legitimate reasons, Boutique Eliza may refuse an order or attach special conditions.

Boutique Eliza shall provide the Consumer, in writing or via durable medium, with:

  • The address where complaints can be submitted

  • Information on the right of withdrawal or its exclusion

  • Warranty details

  • The essential contract details


Article 6 – Right of Withdrawal

For products purchased online, the Consumer has the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, in accordance with the UK Consumer Contracts Regulations 2013.

During this period, the Consumer must handle the product and packaging with care. Only to the extent necessary to establish the nature, characteristics and functioning of the goods may they be unpacked or used.

To exercise the right of withdrawal, the Consumer must notify Boutique Eliza in writing (e.g., by email). The Consumer then has another 14 days to return the goods.

The Consumer bears the direct costs of returning the goods, including any international return costs (e.g. to suppliers outside the UK).


Article 7 – Costs in Case of Withdrawal

If the Consumer exercises the right of withdrawal, the cost of return shipment is borne by the Consumer.

Boutique Eliza shall refund all payments received from the Consumer, excluding delivery costs, within 14 days after being informed of the withdrawal, provided that the goods have been received back or proof of return has been supplied.


Article 8 – Exclusion of Withdrawal

The right of withdrawal cannot be applied to products:

  • Made to the Consumer’s specifications or personalised

  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery

  • Goods which are liable to deteriorate or expire rapidly

  • Digital content not supplied on a tangible medium, if performance has begun with the Consumer’s prior express consent

  • Newspapers, magazines or periodicals (except subscriptions)


Article 9 – Prices

Prices will not be increased during the validity period of the offer, except for VAT changes or legal obligations.

Prices are listed exclusive of import VAT, customs duties, or clearance fees applicable to deliveries into the UK. These are payable by the Consumer.

Typing or printing errors are not binding.


Article 10 – Conformity and Warranty

Boutique Eliza guarantees that products and/or services comply with the contract and applicable UK consumer law.

Any warranties given by the manufacturer or Boutique Eliza do not affect statutory Consumer rights under the Consumer Rights Act 2015.

Defective or incorrectly delivered products must be reported within 30 days.


Article 11 – Delivery and Performance

Boutique Eliza shall exercise due care when receiving and executing orders.

Place of delivery is the address given by the Consumer.

Orders shall be executed promptly, but within 30 days unless otherwise agreed. If delivery is delayed, the Consumer may terminate the contract without cost.

Risk of loss or damage passes to the Consumer once delivery is made.


Article 12 – Duration Transactions

Contracts for ongoing supply (e.g., subscriptions) may be cancelled by the Consumer with one month’s notice. Automatic renewals beyond the initial term are not permitted except under UK law for certain publications.


Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days after order confirmation.

The Consumer must ensure accuracy of payment details.

In case of late payment, Boutique Eliza may charge reasonable recovery costs.


Article 14 – Complaints Procedure

Complaints must be submitted clearly and fully within 7 days after discovery.

Complaints will be answered within 30 days. If longer processing is required, the Consumer will be informed.

A substantiated complaint will be remedied by repair, replacement or refund.


Article 15 – Disputes

Contracts between Boutique Eliza and the Consumer are governed by UK law.
